Acceptance of these Terms of Service This document and these terms (the “Agreement”) are between You (“you,” “your,” or “yourself”) and OkiTel (The ‘’Company’’, ‘’we’’, “us”, “our”) governing your use of OkiTel Messenger, mobile or web services. Constitutes a legal agreement between you and the software (“OkiTel Software”) which is owned, controlled or provided by OkiTel (collectively, the “OkiTel Services”).
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

By using the OkiTel Services, you acknowledge that you have read, understood and agreed to these Terms of Service. If you do not agree to these Terms of Use, please stop using the OkiTel Services immediately.

You acknowledge that this Agreement is solely between you and OkiTel and not with OkiTel’s partners, distributors, promoters or providers of services (collectively, “Distributors”). Acknowledge and agree in, In the event of any problem or claim relating to the OkiTel Service, OkiTel, and not its distributor, shall be solely responsible for resolving the problem or claim.

If you obtained OkiTel Services from a OkiTel reseller, you agree that such reseller has no obligation or liability to provide any warranty, maintenance, and support services related to the OkiTel Services.

NO ACCESS TO EMERGENCY SERVICES: We aren’t designed to connect you to emergency services or any other public safety answering point. You should connect with your relevant emergency services providers through a mobile phone, a fixed-line telephone, or other service.

Age: You must be at least 13 years old to register for and use our Services. In addition to being of the minimum required age to use our Services under applicable law, if you are not old enough to have authority to agree to our Terms in your country or territory, your parent or guardian must agree to these Terms on your behalf. Please ask your parent or guardian to read these Terms with you

1. Grant of License All OkiTel Services are licensed, not sold. Subject to the terms of this Agreement, OkiTel grants you a personal, non-exclusive, non-transferable and non-sublicensable license to use OkiTel Services solely for your personal or internal business purposes.

You may use the OkiTel Software for one OkiTel Services subscription account on up to one (1) mobile device under your lawful control for your personal or internal business use.

If you submit User Data to OkiTel, you grant OkiTel a non-exclusive, royalty-free, worldwide license to distribute User Data through the OkiTel Services solely for the purpose of providing a secure messaging service.
OkiTel does not use, copy or modify any User Data. This is not possible as the data is encrypted and cannot be read

2. RESERVATION OF RIGHTS
OkiTel, its affiliate companies are the owners of OkiTel Services, including all content, visual interfaces and information.
Except for the express license granted, you have no rights, title, interests, or license to OkiTel Services, regardless of whether implied or not.

3. RESTRICTIONS
You agree and acknowledge that you will not reproduce or attempt reproduction of the OkiTel Software, nor any part thereof including but not limited to any direct or indirect computerization, translation, compilation, extraction, derivation or transformation of the content.

4. USER DATA
OkiTel Services may permit you to submit content and materials (” User Data”), and allow for the hosting, storage and distribution of such User Data. Your User Data, and any consequences of their storage or transmission, are your responsibility. OkiTel is not responsible for User Data or any consequences. OkiTel has no control or endorsement of the User Data submitted to it by others. OkiTel has the right to refuse to submit User Data, and to limit or remove User Data at any time.

5. PRIVACY POLICY and Compliance
This Agreement incorporates OkiTel’s Privacy Policies. This Privacy Policy contains important information regarding the collection, use and disclosure of personal data. Please carefully read it. OkiTel may collect and use User Data in accordance with the policy that was in effect at the time data was collected.

OkiTel will make you subject to any guidelines or rules that may be posted about certain features (the “Guidelines”) which are also incorporated into this Agreement.

6. MODIFICATIONS TO THIS AGREEMENT
OkiTel reserves the right to modify these Terms of Service at any time. You will see any and all changes to this Agreement on Okitelecom.com. If you continue to use OkiTel Services, you agree to adhere to these Terms of Service.

7. ACCOUNT INFORMATION
OkiTel is not responsible for any damages to your account information. You agree to not sell, transfer or allow anyone else to access your OkiTel Services account password or OkiTel Services account.

8. USAGE RULES; HARM TO OKITEL OR OUR USERS; PROHIBITED CONDUCT AND USES
Our Services are designed to allow secure end-to–end communication. We don’t have the technical ability to monitor OkiTel Services accounts, or users’ messages. However, we reserve all rights to suspend or terminate accounts for violating the following terms. You cannot use the OkiTel services

a) Infringe patents, trademarks or trade secrets in any way that is in violation of any proprietary or intellectual property right;

b) To distribute, publish, transmit, or facilitate the transmission of unsolicited mass emails or messages, promotions or advertising, or solicitations (or spam)

c) To impersonate another person in a way that is designed to deceive, confuse, or mislead others.

d) To disable, damage, or otherwise interfere security features of OkiTel Services.

e) To intentionally disrupt or damage the OkiTel Services’ operation or any user’s enjoyment thereof, including uploading or disseminating viruses or worms or other malicious code.

f) for any illegal or fraudulent activity

g) To violate the rights or property of another person;

h) To harass others with a targeted harassment tactic

i) To threaten, encourage, promote, or actively encourage violence or terrorism or any other serious harm.

j) Any content or activity that encourages or promotes child sexual abuse or exploitation;

k) It is illegal to transmit or divulge private or confidential information of other people, such as credit card numbers and Social Security/National Identity numbers without their permission.

l) To violate the security, integrity or availability of any user or network, computer, communications system, software program, network or computing device.

m) Without our written consent, you may not use any robot, spider or scraper to access OkiTel Services.

n) You cannot sell, transfer, or allow someone else to access your OkiTel Services account password or OkiTel Services account.

o) You cannot use OkiTel Services if our services are prohibited or viewed as illegal in your country.

9. THIRD-PARTY SERVICES
OkiTel Services may contain links to other websites or services only as a convenience for Users. OkiTel makes no representations or endorses any linked sites, or any information or materials available through them. OkiTel disclaims any liability related to your use these linked sites.

10. VIOLATIONS; TELEMINATION
OkiTel can suspend or terminate your access to OkiTel Services at any time without notice or liability. This includes if OkiTel believes that you have violated any terms or conditions of this Agreement. OkiTel also has the right to determine that you have repeatedly infringed or infringed copyrights of other people. OkiTel may also suspend or terminate your OkiTel Services access based on extended inactivity or unpaid subscriptions. These remedies may be used in conjunction with any other remedies OkiTel may have under law. OkiTel reserves all rights to end Free Accounts or to deny access to OkiTel Services at any time, without prior notice and without liability.

11. DISCLAIMER; NO WARRANTIES
ALL THIRD-PARTY SOFTWARE OR SERVICES, INCLUDING THE OkiTel Services, ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY. To the maximum extent permitted by applicable law, OkiTel and its SUPPLIERS and PARTNERS DISCLAIM ALL WARRANTIES EXPRESSED OR IMPLIED. This includes, but not limited to, IMPLIED WARRANTIES of MERCHANTABILITY, AND NON-INFRINGEMENT OF PROPRIETARY REGARDS. OkiTel and its SUPPLIERS and PARTNERS do not warrant that the OkiTel Services or their servers will be uninterrupted or error-free, that any defects will be corrected, that there are no harmful components in OkiTel Services, or that they will meet your requirements. You are solely responsible for any damage to your equipment or device, loss of use, or loss of data.

12. INDEMNIFICATION. HOLD HARMLESS
OkiTel and its affiliate companies and its partners are to be held harmless from any claims, suits and actions, losses and damages, as well as attorneys’ fees. These liabilities include any liability arising out of or in connection with

(a) OkiTel Services use or misuse,

(b) violation of rights by any person or entity, or

(c), any breach of this Agreement.

13. LIMITATION OF LIABILITY & DAMAGES
To the extent permitted by applicable law, OkiTel or its affiliates contractors, employees, agents or third-party suppliers will not be liable for any special indirect, direct, incidental or punitive damages related to your use of the okitel services.

14. MISCELLANEOUS
This Agreement is the complete agreement between the parties regarding the subject matter and supersedes any prior or contemporaneous oral, or written understandings. Only one of the parties may amend this Agreement.
This Agreement will be governed solely by Albanian law.
